ARPA: SMC Contract Change Order and Bioretention Maintenance

I move the Mayor and Council authorize the City Administrator to execute a change order to the existing contract with SMC to increase the not to exceed value of the contract to $1,500,000 and extend the end date of the contract to December 31, 2025. Additionally, an expenditure not to exceed $133,000 is authorized, to be funded using American Rescue Plan Act (ARPA) funds for the maintenance of bioretention facilities, rain gardens, and other stormwater infrastructure throughout the City. The Treasurer is authorized to make the budget amendments necessary to encumber the funds authorized.

Summary Background:
In 2019 the City solicited a request for proposal (RFP) for firms to provide On-call environmental and stormwater design and engineering services. SMC was one of the selected contractors and the Council authorized the initial contract. In April 2022, in response to the ARPA fund program the Council authorized a change order to increase the not to exceed value of the on-call contractors to $750,000 in anticipation of the awarding of ARPA funded projects. Since the time when the City received the ARPA funds, the City also received a Federal Congressional earmark for $890,000 in funding for Lower Ward 1 flooding resiliency projects, many of which SMC will be a part of the design and construction. The change order is needed to ensure that SMC can continue to work on and complete the ARPA, Lower Ward 1, and other stormwater related projects through the end of funding authorizations.
Over the past 10+ years the City has constructed over 17 bioretention, rain garden, and other stormwater structures throughout the City with at least 6 more being constructed over the next 2 years. In the fall of 2023, the Council authorized APRA funding to be used for the maintenance of these facilities.
