I move the Mayor and Council adopt Ordinance 2021-03, an ordinance whereby the City Council amends the City of Hyattsville Code to decrease the maximum penalty for nonpayment of parking fines to no more than one- and one-half (1.5) times the value of the original fine after thirty days of nonpayment (SECOND READING & ADOPTION).

Summary Background:
In December 2020, the City Council adopted Motion HCC-162-FY21, a motion to restrict the maximum fine for nonpayment of parking violations to no more than one and a half (1.5) times the value of the original fine after thirty (30) days of nonpayment. The City Attorney’s office has drafted the attached ordinance for the City Council to consider for adoption. If adopted, the ordinance will take effect on July 1, 2021, the start of the new fiscal year.
Next Steps:
A first reading was held on May 17, 2021. Second reading and adoption. The ordinance will be effective 20 days post adoption. A legal summary of the ordinance will be published in Prince George’s Post.
Fiscal Impact:
Staff projects the revisions to the parking fee schedule to create a gross revenue reduction of 25% - 30% or $133,500 - $160,200 annually.

The updated ordinance is consistent with Council direction.
