I move the City Council authorize the City Administrator to execute a Memorandum of Understanding (MOU) with the Maryland State Highway Administration (SHA) for the costs of pedestrian trail lighting, up to, but not exceeding, $165,000 and the maintenance of fencing for the Rhode Island Avenue Trolley Trail (RIATT) Project, subject to review for legal sufficiency by the City Attorney.

Summary Background:
Maryland SHA has completed the permit design of the RIATT project and developed a lighting cost estimate of $318,148. The City and Maryland SHA will be partially sharing the overall costs of the pedestrian lighting, with the City absorbing some additional costs due to a requested conduit for future use. The City budgeted $250,000 in the FY2021 Capital Improvement Plan, which was reauthorized in the FY2022 Capital Improvement Plans (CIP) to cover the costs of the RIATT lighting improvements. The City will be responsible for contributing $163,666.22 to the project costs, however the City and Maryland National Capital Park and Planning Commission (M-NCPPC) have discussed M-NCPPC covering up to 50% of the City's portion of costs, through a separate MOU, to be approved later this year.

The City will also be required to execute an amended MOU for maintenance of supplemental safety fencing along the sidewalk portion of the trail. The authorization being requested by the City Council is intended to authorize the City Administrator to execute that supplemental MOU without additional action of the City Council.
